Western Leisure, Inc.
Effective Date: January 1, 2019
These Terms & Conditions govern the relationship between Western Leisure, Inc. (“Western Leisure,” “we,” “us,” or “our”) and each person (“passenger,” “traveler,” or “you”) who purchases or participates in any Western Leisure tour or travel program, whether the booking is made directly with Western Leisure or through a group leader, travel agent, or tour operator partner (“booking agent”).
By submitting a reservation, deposit, or participation in a Western Leisure tour, you agree to be bound by these Terms & Conditions.
1. Booking Responsibility
Most Western Leisure tour bookings are coordinated through tour operators, travel agencies, or group leaders (“booking agent”). Your booking agent is responsible for:
- Collecting payment from passengers
- Providing Western Leisure with accurate rooming lists and passenger information
- Communicating itinerary details and requirements
Western Leisure does not accept responsibility for errors or omissions by your booking agent.
2. Payments
All payments must be made to your booking agent. Reservations are not confirmed until full payment is received by Western Leisure from your booking agent. Failure by your booking agent to remit payment may result in cancellation of your reservation.
3. Cancellations & Refunds
All cancellation requests must be made through your booking agent. The following cancellation policy applies unless otherwise stated in your program documents:
Full Tour Cancellation
If your tour is canceled by the group or booking agent:
- 90 days or more prior to departure: Full refund of payments
- 89–60 days prior to departure: Deposit + any non-refundable vendor payments forfeited
- 59 days or less: No refund
Individual Passenger Cancellation
If you cancel your reservation:
- 60+ days before departure: Full refund
- 59–15 days: Western Leisure retains 50% of tour cost
- 14–8 days: Western Leisure retains 75% of tour cost
- 7 days or less: No refund
If cancellations reduce group size below the contracted minimum, a price adjustment may be applied.
4. Travel Protection / Insurance
Western Leisure strongly recommends the purchase of travel insurance to protect against financial loss due to trip cancellation, illness, medical emergencies, baggage delay, or travel interruption.
Travel insurance is not included in tour pricing and must be purchased separately. Passengers decline travel insurance at their own risk.
5. Itinerary Changes
Western Leisure reserves the right to:
- Substitute hotels, attractions, or transportation if necessary
- Adjust the order of sightseeing
- Modify activities due to weather, availability, or safety considerations
Every effort will be made to provide comparable services.
6. Health & Fitness Requirements
Travelers must be in good physical health to participate. Many tours involve walking, stairs, uneven surfaces, and moderate activity.
- Western Leisure is not responsible for providing individual assistance.
- Passengers requiring special assistance must travel with a capable companion.
- Western Leisure complies with the Americans with Disabilities Act (ADA) to the extent possible but is not responsible for the accessibility of third-party suppliers (hotels, motorcoachs, attractions, etc.).
7. Medical Conditions & Special Needs
You must inform your booking agent of:
- Any mobility restrictions or medical conditions
- Dietary needs or allergies
- The need to store medication requiring refrigeration
Western Leisure is not responsible for medical care, and any necessary treatment will be at the traveler’s expense.
8. Passports & International Travel
For travel outside the United States, a valid passport is required. Passports must be valid for at least six months after return. Entry into foreign countries is not guaranteed.
Canada Entry Notice: Travelers with certain criminal convictions (including DUI/DWI) may be denied entry into Canada.
9. Behavior & Removal from Tour
Western Leisure reserves the right to remove any passenger from the tour if their behavior:
- Endangers themselves or others
- Interferes with group enjoyment
- Is unlawful, abusive, or disruptive
All removal expenses are the responsibility of the passenger with no refund.
10. Baggage Responsibility
Western Leisure is not responsible for loss, theft, or damage to baggage or personal belongings. Baggage insurance is recommended.
11. Force Majeure
Western Leisure is not responsible for delays or cancellations due to events beyond its control, including weather, natural disasters, civil unrest, labor strikes, pandemics, or government actions.
12. Responsibility & Liability
Western Leisure acts as a tour operator and contracts with independent suppliers (hotels, motorcoach companies, attractions, restaurants). Western Leisure is not liable for:
- Injury, death, accident, delay, property damage
- Acts or omissions of any third-party supplier
- Acts of God, mechanical failure, safety incidents, or additional travel costs
13. Photo & Video Release
Passengers grant Western Leisure the right to use trip photos or video likenesses for marketing or promotional purposes without compensation.
14. Payment Disputes / Chargebacks
By participating in this tour, you agree not to initiate a credit card chargeback for services provided. All disputes must be resolved through arbitration.
15. Arbitration Agreement
Any dispute between you and Western Leisure will be resolved by binding arbitration in Salt Lake County, Utah in accordance with the rules of the American Arbitration Association.
16. Governing Law
These Terms are governed by the laws of the State of Utah.
17. Acknowledgment of Terms
By traveling with Western Leisure, you agree to these Terms & Conditions whether you sign a paper form or electronically accept them.
